This page sets out the Privacy Policy, Terms of Use, and Intellectual Property & Copyright Notice for madartistpublishing.com (the "Site"), operated by Mad Artist Publishing Ltd. ("MAP", "we", "us", or "our"). Together with our Refund Policy and any product-specific licence shown at checkout, this is the binding agreement between you and MAP. By using the Site, creating an account, subscribing to our newsletter, or completing a purchase, you accept this entire agreement. If you do not agree, please stop using the Site.
Part A — Privacy Policy
A1. Who we are and how to contact us

A2. The information we collect
We collect only what we need to run the Site and fulfil your orders. The categories below describe everything we may receive about you.
(a) Information you give us directly
- Account & order details — your name, billing address, shipping address, email address, telephone number, and the items you order. We need this to process payment, ship physical goods, deliver digital downloads, send receipts, and provide customer service.
- Communications — when you email us, fill in a contact form, post a comment, leave a review, or reply to a newsletter, we keep that correspondence and any information you choose to include.
- Marketing preferences — whether you have opted in to our newsletter and any preferences you set.
(b) Payment information — processed by Stripe, not stored by us
All card payments on the Site are processed by Stripe, Inc. ("Stripe"). When you check out, your card number, expiry, CVC, and full billing details are entered into Stripe's hosted Checkout page or its tokenisation library and are transmitted directly to Stripe over an encrypted connection. We never see, store, or have access to your full payment-card number or CVC. Our servers receive only the limited details that Stripe returns to us, namely:
- a Stripe payment intent / session ID (a reference token);
- the last four digits of the card and the card brand (for receipt and refund purposes);
- the name, billing email and billing address you supplied to Stripe;
- the currency, amount, and payment status (paid / refunded / disputed).
This arrangement means cardholder data is held only by Stripe, a PCI-DSS Level 1 service provider. Stripe's handling of your data is governed by Stripe's own Privacy Policy (stripe.com/privacy).
(c) Information collected automatically
- Device & connection data — your IP address, approximate location (city / region derived from IP), browser type and version, operating system, screen resolution, language preference, and the referring URL.
- Usage data — pages viewed, products clicked, search queries entered, time and duration of visits, and the order in which pages are visited.
- Cookies & similar technologies — see Section A8 below.
(d) Information from third parties
If you reach the Site by clicking an advertisement or an affiliate link (including links we publish to BangGood or other retailers), the originating service may share with us non-identifying information about the click, such as the campaign or referral ID. When you complete a sign-in via a social or single sign-on provider (if and where offered), that provider will pass us the basic profile fields you authorise.
A3. How we use your information
- To fulfil contracts with you — process your order, charge payment (via Stripe), deliver physical and digital products, manage returns and refunds, and provide receipts and shipping notifications.
- For customer service — respond to enquiries, complaints, and warranty claims.
- To operate and improve the Site — administer accounts, prevent abuse, monitor performance, and develop new features.
- For security and fraud prevention — detect and block fraudulent orders, scraping, brute-force log-in attempts, and other abuse.
- For marketing (only with your consent) — send newsletters and promotional emails. You can unsubscribe at any time using the link in every email or by emailing us.
- To comply with legal obligations — keep tax and accounting records, respond to lawful requests from authorities, and enforce our Terms of Use.
A4. Legal bases (EEA / UK / Switzerland users)
Where the EU/UK General Data Protection Regulation applies, our legal bases are: performance of a contract (orders, payments, delivery); consent (newsletters, optional cookies); legitimate interests (security, fraud prevention, customer service, basic analytics); and legal obligation (tax, accounting, lawful requests).
A5. Who we share information with
We do not sell, rent, or trade your personal information. We share it only with the following categories of recipients, and only as needed:
- Stripe, Inc. — payment processing (see A2(b)).
- Hosting and infrastructure — DigitalOcean, LLC, where our servers run. Server logs remain on those servers under our control.
- Email delivery — reputable transactional / marketing email providers, receiving only the details needed to deliver the message.
- Analytics — privacy-respecting analytics tools (e.g., Google Analytics) that may receive your IP address and usage events.
- Embedded content — pages may embed third-party content such as YouTube videos. Those services may set their own cookies and collect data under their own privacy policies.
- Affiliate retailers — clicking a BangGood (or similar) affiliate link takes you to that retailer's website. From that point on, your information is collected and used by them under their own privacy policies.
- Shipping carriers — we share your name and shipping address with the courier you select (e.g., Canada Post, UPS) to deliver physical products.
- Professional advisors — lawyers, accountants and auditors, when needed and under confidentiality.
- Authorities — if compelled by valid legal process, court order, or where required to protect rights, property, or safety.
- Business transfers — if MAP is involved in a merger, acquisition or sale of assets, your information may be transferred as part of that transaction. We will provide notice before such a transfer becomes effective.
A6. International transfers
Our primary servers are located in Canada. Some service providers (including Stripe and Google) process data in the United States and other jurisdictions. Where personal information is transferred outside your country, we rely on legally recognised transfer mechanisms such as Standard Contractual Clauses, adequacy decisions, or the provider's own approved transfer frameworks.
A7. How long we keep your information
- Order records — kept for at least seven (7) years after the order to comply with Canadian tax and accounting law.
- Account information — kept while the account is active. You can ask us to close and delete it at any time.
- Newsletter list — kept until you unsubscribe; we keep a suppression record of unsubscribes so we do not email you again.
- Server logs & security events — kept up to twelve (12) months for security investigation, then deleted or anonymised.
- Customer-service correspondence — kept for as long as needed to resolve the matter plus a reasonable archival period.
A8. Cookies and similar technologies
We use cookies and similar storage to make the Site work and to understand how it is used:
- Strictly necessary — required for the cart, checkout, and login to function. These cannot be disabled without breaking the Site.
- Preference — remember settings such as currency, language, or whether you have dismissed a banner.
- Analytics — help us count visitors and understand traffic patterns; we anonymise IP addresses where possible.
- Third-party — set by embedded providers (e.g., YouTube, Stripe Checkout) when you interact with their content.
You can refuse or delete cookies from your browser at any time, but parts of the Site (notably the cart and checkout) may not function.
A9. Your rights
Depending on where you live, you may have rights to access, correct, delete, restrict, port, or object to processing of your personal information, as well as the right to withdraw consent and to complain to a regulator. In Canada, the Office of the Privacy Commissioner is at priv.gc.ca. To exercise any right, email madartistpublishing@gmail.com with the subject "Privacy Request". We respond within 30 days. We may need to verify your identity first.
A10. Security
We use TLS encryption for all traffic, strict access controls on the database, hashed and salted passwords, payment processing by a PCI-DSS Level 1 provider (Stripe), regular software updates, and least-privilege server configuration. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security. If we learn of a breach affecting your personal information, we will notify you and the relevant authorities as required by law.
A11. Children
The Site is not directed to children under 13 (or under 16 in the EU/UK). We do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.
A12. Do Not Track
We do not currently respond to browser "Do Not Track" signals, as no industry consensus exists on how to do so. We do honour opt-outs and the rights described in A9.
A13. Changes to this policy
We may update this policy from time to time; the "Last updated" date at the top will reflect changes. For material changes we will provide additional notice (banner, email). Continuing to use the Site after changes take effect constitutes acceptance.
Part B — Terms of Use
B1. Acceptance and eligibility
By accessing the Site you confirm that you are at least 16 years old (or the age of majority in your jurisdiction, whichever is greater) and that you have full legal capacity to enter into a binding contract. If you are using the Site on behalf of an organisation, you confirm that you are authorised to bind that organisation.
B2. Your account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly at madartistpublishing@gmail.com if you suspect unauthorised use. We may suspend or terminate any account that we reasonably believe is being used to violate these Terms, to commit fraud, or to harm the Site or other users.
B3. Orders, pricing and availability
Prices are shown in the currency indicated at checkout and are exclusive of any applicable taxes and shipping unless stated otherwise. Where Canadian sales tax applies, it will be added at checkout. Prices, descriptions, and availability are subject to change without notice; we reserve the right to refuse or cancel any order (for example, where stock is exhausted, where there is an obvious pricing error, or where we suspect fraud). If we cancel an order you have already paid for, we will refund the full amount through Stripe.
B4. Payment
Payment is taken at the time you place the order, via Stripe. By submitting payment information you authorise us, through Stripe, to charge the payment method you provide for the full amount of the order, including any taxes and shipping. You confirm that you are the cardholder or are otherwise authorised to use the payment method.
B5. Shipping and delivery
Physical products are typically shipped within 2–3 business days from the date of order to the address you provide at checkout. Delivery times depend on the carrier and destination. Risk of loss passes to you on delivery to the carrier; we will reasonably assist with any carrier claim. Customs duties or import taxes for international orders are your responsibility.
B6. Digital products and licence
Digital products (e-books, downloadable PDFs, 3D model files, training materials, and similar) are delivered electronically. Upon successful payment we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the digital product for your own personal or internal business use only. You may not:
- resell, redistribute, share, lend, sublicense, rent or lease the digital product;
- post the digital product (in whole or in part) on any website, file-sharing service, social network, training course, or other public platform;
- use the digital product to train, fine-tune, or evaluate any machine-learning model or generative AI system without our prior written consent;
- remove or alter any copyright, trademark or other proprietary notice;
- circumvent, disable or otherwise interfere with security or access-control features.
For 3D model files, the licence is for personal printing and prototyping only unless a broader commercial licence is shown at checkout. Mass production, reselling printed copies, and commercial distribution require a separate licence agreement with MAP.
B7. Refunds
- Physical products — you may request a refund within 14 days of delivery, provided the product is returned unused and in its original packaging at your cost. Refunds will be issued through Stripe to the original payment method.
- Digital products — because digital products are delivered immediately and cannot be returned, all sales are final once the download has been initiated, except where required by law or in cases of demonstrable technical failure. If a digital product is faulty or fails to download, contact us and we will resolve it (replacement download or refund).
- Affiliate purchases (e.g., items purchased on BangGood through one of our links) are governed by the third party's refund policy; we cannot refund a purchase we did not receive payment for.
B8. Acceptable use
You agree not to:
- use the Site for any unlawful, fraudulent, or harmful purpose;
- interfere with or disrupt the Site, the servers, or networks connected to it;
- access the Site by automated means (scrapers, bots, crawlers) except for well-behaved search-engine crawlers respecting robots.txt;
- attempt to gain unauthorised access to any part of the Site, account, or related systems;
- use the Site to send spam, malware, viruses, or any harmful code;
- impersonate any person or entity, or misrepresent your affiliation;
- reverse engineer, decompile, or disassemble any part of the Site or its software;
- use the content of the Site to train any machine-learning or generative-AI model.
B9. User-generated content
If you post comments, reviews, ratings, or any other content on the Site, you grant MAP a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, adapt, publish, translate, and display that content in any media, in connection with the Site and MAP's business. You represent that you own or have the necessary rights to grant this licence, that the content does not infringe any third-party right, and that it is not unlawful, defamatory, obscene, or otherwise objectionable. We may remove or refuse any user content at our discretion.
B10. Affiliate disclosure
Some links on the Site (for example, links to BangGood, Amazon, or similar retailers) are affiliate links. If you click one and make a purchase, we may receive a commission at no extra cost to you. We only feature products we genuinely believe are useful to our audience, and our editorial decisions are not for sale.
B11. Disclaimer of warranties
The Site and all content, products and services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected. Nothing in these Terms excludes or limits any warranty or liability that may not lawfully be excluded.
B12. Limitation of liability
To the maximum extent permitted by law, MAP, its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site, even if MAP has been advised of the possibility of such damages. MAP's total aggregate liability for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the greater of (a) the amount you paid to MAP in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD 100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability will be limited to the smallest extent permitted by law.
B13. Indemnification
You agree to defend, indemnify, and hold harmless MAP and its directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including legal fees) arising from: (a) your use of, or inability to use, the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual-property, privacy, or proprietary right; or (d) any content you submit to the Site.
B14. Termination
We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including B6 licence restrictions, B9 user-content licence, B11–B13, and B16) will survive.
B15. Changes to the Terms
We may revise these Terms from time to time. The "Last updated" date will change. Continued use of the Site after a revision constitutes acceptance.
B16. Governing law and jurisdiction
This agreement, and all matters related to your use of the Site, are governed by the laws of the Province of Ontario, Canada, and the laws of Canada applicable therein, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada, subject to any non-waivable consumer-protection rights you may have under your local law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
B17. Entire agreement; severability; waiver
This page (together with our Refund Policy and any product-specific licence shown at checkout) constitutes the entire agreement between you and MAP regarding the Site, and supersedes any prior agreement. If any provision is held unenforceable, the remaining provisions remain in full force. Failure to enforce any right is not a waiver of that right.
Part C — Intellectual Property & Copyright Notice
C1. Ownership
All content on the Site — including but not limited to text, articles, blog posts, artwork, illustrations, photographs, graphics, logos, icons, videos and embedded films, audio, music, animations, e-books, PDFs, 3D model files, source files, training materials, course curricula, software, source code, layout, structure, "look and feel", and trademarks — is the property of Mad Artist Publishing Ltd. or its licensors, contributing artists, or content partners, and is protected by Canadian and international copyright, trademark, and other intellectual-property laws and treaties, including the Copyright Act (Canada), the Berne Convention, and the WIPO Copyright Treaty.
C2. Permitted use
You may view the Site for personal, non-commercial purposes only. You may not copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works of, display, sell, or otherwise exploit any content on the Site without our prior written consent or a clearly-granted licence (for example, the licence terms in Part B6 for purchased digital products).
C3. Trademarks
"Mad Artist Publishing", "MAP", the MAP logo, and any other names, logos, taglines and product names used on the Site are trademarks or registered trademarks of MAP. All other trademarks, service marks, and trade names appearing on the Site are the property of their respective owners. Nothing on the Site grants any licence to use any of these marks.
C4. Artists and partners
Many works featured on the Site are licensed to MAP by their authors or owners for the specific purpose of being displayed or sold on the Site. Their underlying copyrights remain with those authors. Purchasing a product on the Site does not transfer copyright of the underlying work to you; you receive only the licence described in Part B6.
C5. AI training prohibition
Use of any content on the Site — including text, images, video, audio, e-books, 3D files and source files — to train, fine-tune, evaluate, or otherwise develop any machine-learning, generative, or large-language-model system is expressly prohibited. This prohibition is a condition of access and applies to scraping, mirroring, dataset compilation, and any other automated bulk use of the content. Operators of such systems must obtain a separate written licence from MAP before any such use.
C6. Copyright complaints (DMCA / notice and takedown)
MAP respects the intellectual-property rights of others. If you believe content on the Site infringes your copyright, please send a written notice to madartistpublishing@gmail.com with the subject line "Copyright Notice" containing all of the following:
- a description of the copyrighted work claimed to have been infringed;
- the URL(s) of the allegedly infringing material on the Site;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on its behalf;
- your physical or electronic signature.
We will investigate and respond to properly submitted notices. Knowingly submitting a false notice may expose you to liability.
C7. Counter-notice
If you believe content you posted to the Site was removed in error, you may send a counter-notice to the same email address, identifying the material, stating under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, and consenting to the jurisdiction of the courts of Ontario, Canada.
C8. Reservations
All rights not expressly granted in these Terms are reserved by Mad Artist Publishing Ltd. and its licensors.
